The following terms apply to every ticket holder, attendee, vendor, sponsor, performer, and guest of Freedom Cup Fest — held July 3, 4, and 5, 2026 at Partake in Long Island City, NYC. By purchasing a ticket, entering the venue, or submitting an application, you agree to these terms in full. Please read them.

Definitions

Words we use a lot.

These terms are referenced throughout this document.

Festival / EventFreedom Cup Fest, taking place July 3–5, 2026 at Partake, Long Island City, NYC, including any related programming, day parties, night parties, viewing zones, and on-site activations.
Organizer / ProducerElevated LIC LLC and Partake LLC, jointly producing and presenting the Festival, together with their respective members, managers, affiliates, parents, subsidiaries, officers, directors, employees, contractors, producers, hosts, licensors, and authorized agents (collectively, the “Released Parties”).
Released PartiesAs defined above — Elevated LIC LLC, Partake LLC, and each of their respective members, managers, affiliates, parents, subsidiaries, officers, directors, employees, contractors, producers, hosts, licensors, sponsors, performers, vendors, security and medical providers, and authorized agents.
VenuePartake (and its outdoor and indoor zones) located in Long Island City, NY, including any adjacent space licensed by the Organizer for Festival use.
Attendee / YouAny person entering the Venue under a Festival ticket, credential, wristband, vendor pass, sponsor pass, or staff pass.
TicketAny GA, VIP, weekend, day, table, or reserved-section pass sold or issued by the Organizer or an authorized ticketing partner.
Ticket Terms

Your ticket is a revocable license.

A ticket grants you a one-time, revocable license to attend the Festival on the date(s) printed on it, subject to these terms and to all venue, local, state, and federal rules. It is not a property right and does not entitle you to a specific seat, view, or experience unless explicitly stated on the ticket.

Resale & transfer

Tickets are issued to a named purchaser. Resale above face value, scalping, or commercial transfer is prohibited and may render the ticket void without refund. The Organizer reserves the right to invalidate any ticket purchased through unauthorized channels.

Counterfeit & duplicate scans

Each ticket is valid for a single scan. The first scan controls. If a duplicate, screenshot, or photocopied ticket arrives later, it will be refused. The Organizer is not responsible for tickets purchased from unauthorized resellers or for tickets that are lost, stolen, or destroyed.

Age & minors

Certain zones (including all bars and the 21+ VIP section) require a valid government-issued photo ID showing 21 years of age or older. Minors may only attend with a ticketed parent or legal guardian, and only in the designated all-ages zones. See §04 — Entry, ID & Age.

Refunds & Exchanges

No refunds. Period.

★ Strict No-Refund Policy

All ticket, table, bottle-service, F&B, parking, and merchandise sales are final at the time of purchase. By completing your purchase, you acknowledge and agree that you are not entitled to a refund, credit, exchange, or chargeback under any circumstance, except where a non-waivable right is granted to you by applicable law.

Without limiting the foregoing, refunds and exchanges will not be issued for any of the following:

  • Change of mind, scheduling conflicts, or buyer's remorse
  • No-shows, late arrivals, or early departures
  • Partial attendance — including attending only one or two days of a weekend pass
  • Refusal or removal for violation of these terms, intoxication, or failure to pass ID / security screening
  • Lost, stolen, damaged, or unredeemed tickets, wristbands, or QR codes
  • Weather of any kind, including rain, heat, wind, or cold — the Festival is rain-or-shine (see §09)
  • Schedule changes, set-time adjustments, delays, or programming modifications
  • Performers or DJs added, removed, substituted, or rescheduled at any time
  • Capacity limits, line waits, or temporary closure of any zone, bar, or stage
  • Sound, sightline, view, or any subjective aspect of the experience
  • Failure or delay of third-party services (transit, rideshare, parking, ticketing platform)
  • Personal injury, illness, or any inability to attend for personal reasons

Cancellation or postponement

If the Festival is cancelled, postponed, rescheduled, or materially shortened by the Organizer for any reason — including force majeure (see §09) — your ticket will, at the Organizer's sole discretion, be honored for the rescheduled date or converted to a non-transferable credit applicable to a future Freedom Cup Fest event within twenty-four (24) months. No cash refund will be issued, except where required by non-waivable consumer-protection law in your jurisdiction.

Lineup changes

Performer lineups are inherently subject to change without notice. The Festival is a multi-act, multi-zone experience and no single performer is the basis of the bargain. A change, substitution, no-show, or removal of any performer — including headliners — is not grounds for a refund, credit, or exchange.

Tables, bottle service & add-ons

Reserved tables, bottle minimums, bottle service, sections, parking passes, VIP upgrades, merchandise, and any other add-on are final at purchase and non-refundable, non-transferable, and non-exchangeable. Unused F&B credit, bottles, or service minimums do not carry over to another day or event and have no cash value.

Removal for cause

If you are denied entry, removed from the Venue, or have your wristband revoked for any reason under §04 or §05, your ticket is forfeited in full with no refund, credit, or pro-rated adjustment.

Chargebacks

You agree not to initiate a chargeback, dispute, or payment reversal with your bank or card issuer for any Festival purchase. If you have a concern about a charge, email Hello@Partake.NYC first and we will respond within ten (10) business days. Filing a chargeback in breach of this section is a material breach of these terms and will result in: (a) immediate voiding of the disputed ticket and any associated wristband or credential; (b) denial of entry; (c) recovery by the Organizer of all chargeback fees, collection costs, and reasonable attorneys' fees; and (d) a permanent ban from future Freedom Cup Fest events.

Payment processors

Ticket purchases are processed by Posh (our ticketing platform) with payment handled by Stripe. Sponsor, vendor, and other B2B invoices are processed directly through Stripe. The merchant of record is Elevated LIC LLC / Partake LLC. The Organizer is not liable for any failure, delay, fraud, or breach attributable to a payment processor or to your bank or card issuer.

Acknowledgement

By completing checkout, clicking "I agree," entering the Venue, or accepting a wristband, you expressly acknowledge that you have read, understood, and agreed to this no-refund policy and that you are paying the Organizer in consideration of a revocable license to attend — not a guaranteed outcome.

Entry, ID & Age

Bring ID. Expect to be screened.

By entering the Venue you consent to a search of your person, bags, and belongings by Festival staff, venue staff, or law enforcement. Entry may be conditioned on metal detection, bag inspection, ID verification, and confirmation that your wristband is intact and worn correctly.

Acceptable ID

  • U.S. state-issued driver's license or non-driver ID
  • U.S. passport or passport card
  • Foreign passport (with photo)
  • U.S. military ID

Expired IDs, photocopies, and photos of IDs are not accepted. The Organizer reserves the right to refuse any ID it cannot verify.

Re-entry

Re-entry may be permitted but is not guaranteed. If re-entry is suspended due to capacity, weather, or security, your exit is final. Hold onto your wristband.

Right of refusal

The Organizer reserves the right to refuse entry to, or remove from the Venue, any person who: appears intoxicated; behaves in a manner that endangers others; refuses inspection; carries a prohibited item; presents an invalid or counterfeit ticket; or otherwise violates these terms. Removal is without refund.

Code of Conduct

Be cool. Or be removed.

Freedom Cup Fest is for everyone. We have zero tolerance for harassment, discrimination, violence, or unsafe behavior of any kind. Specifically prohibited:

  • Harassment, threats, or unwanted physical contact toward any person
  • Discrimination on the basis of race, ethnicity, national origin, gender, gender identity, sexual orientation, religion, age, or disability
  • Fighting, throwing objects, or climbing on structures, fences, stages, or speakers
  • Selling, distributing, or being visibly under the influence of illegal drugs
  • Tampering with safety equipment, exits, fire lanes, or barricades
  • Trespassing into back-of-house, talent, vendor-only, or staff-only areas

If you experience or witness conduct that violates this policy, find a staff member in a marked vest or text the safety line printed on your wristband. Reports are taken seriously and handled confidentially.

Prohibited Items

Leave it at home.

The following items are not permitted inside the Venue. This list is not exhaustive and the Organizer may, at its sole discretion, refuse any item.

  • Weapons of any kind, including firearms, knives, mace, and tasers — even with a permit
  • Illegal drugs, drug paraphernalia, and nitrous oxide
  • Outside food or beverage (sealed water under 20 oz is permitted)
  • Glass containers of any kind
  • Professional cameras (detachable lens), audio recorders, drones, and selfie sticks over 18"
  • Laser pointers, flares, fireworks, and any open flame
  • Hard-sided coolers, large backpacks (over 12"×12"×6"), and rolling bags
  • Pets (service animals welcome — see §13)
  • Markers, spray paint, stickers, and unauthorized promotional materials

Items confiscated at entry will not be returned. There is no on-site bag check.

Assumption of Risk

Live events carry inherent risk.

You understand and acknowledge that attending a live, outdoor, multi-day festival involves inherent risks, including but not limited to: exposure to weather and direct sun; loud noise that may cause hearing damage; strobe and laser lighting (which may trigger photosensitive conditions); large crowds, jostling, and crowd-surge; food and beverage allergens; alcohol consumption by other patrons; trip-and-fall hazards; and the actions of other attendees.

By entering the Venue, you voluntarily assume all such risks, known and unknown, even if caused in whole or in part by the ordinary negligence of any of the Released Parties.

★ Photosensitive notice

This Festival uses strobe lighting, lasers, haze, pyrotechnic effects, and loud sound reinforcement. If you have epilepsy, a heart condition, or any photosensitive condition, please consult a physician before attending and notify staff at entry if you require accommodation.

Release, Hold Harmless & Indemnification

The protective stuff.

★ Read this carefully — it limits your legal rights

By purchasing a Ticket, entering the Venue, or submitting any application to the Festival, you agree to the release, hold-harmless, and indemnification obligations in this section on behalf of yourself, your minor children, your guests, your heirs, your estate, and anyone claiming under or through you.

Release & waiver of claims

To the fullest extent permitted by law, you hereby release, waive, discharge, and covenant not to sue the Released Parties (as defined in §01) — including without limitation Elevated LIC LLC and Partake LLC — from any and all liability, claims, demands, actions, causes of action, damages, costs, expenses, and attorneys' fees, of any nature whatsoever, whether known or unknown, arising out of or in any way related to:

  • Your purchase of a Ticket or other Festival product or service
  • Your presence at, attendance at, entry into, or departure from the Venue
  • Any act or omission of any Released Party, any other attendee, performer, vendor, sponsor, contractor, or third party
  • Any personal injury, illness, disability, or death however caused
  • Any property loss, theft, or damage, including damage to vehicles
  • Any food- or beverage-borne illness, allergen exposure, or alcohol-related event
  • Any exposure to communicable disease, including but not limited to COVID-19
  • Heat, sun, weather, crowd-surge, noise, strobe, laser, or pyrotechnic exposure
  • Any cancellation, postponement, delay, or modification of the Festival

This release applies even if such liability, claim, or damage is caused in whole or in part by the ordinary negligence of any Released Party. This release does not apply to liability arising from a Released Party's gross negligence, willful misconduct, or any other liability that cannot lawfully be released under applicable law.

Hold harmless

You agree to hold harmless each of the Released Parties from any liability, loss, or expense (including reasonable attorneys' fees) of any kind arising out of or related to your attendance at the Festival, your use of the Venue, your acts or omissions, or the acts or omissions of any minor or guest accompanying you.

Indemnification

You agree to defend, indemnify, and hold harmless the Released Parties from and against any and all third-party claims, demands, suits, judgments, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:

  • Your breach of these terms, including the Code of Conduct (§05)
  • Your acts, omissions, negligence, or willful misconduct at the Festival or on Venue property
  • Any injury, damage, or loss you cause to another attendee, performer, vendor, Released Party, or third party
  • Your violation of any law, regulation, ordinance, or third-party right
  • Content you submit through any Festival form, including the Brand Kit portal
  • For sponsors and vendors: your on-site activation, product, service, sampling, employees, contractors, and the conduct of your booth or activation

The Released Parties reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify, and you agree to cooperate with their defense of such claim.

Minors & guests

If you bring a minor child or any guest into the Venue, you represent that you are legally authorized to do so and you assume the same release, waiver, hold-harmless, and indemnification obligations on their behalf. Parents and guardians assume full responsibility for their minor children at all times.

Survival

The release, waiver, hold-harmless, and indemnification obligations in this section survive the conclusion of the Festival, the expiration or termination of your Ticket, and the termination of these terms, and inure to the benefit of each Released Party.

Media Release

You may end up in the recap reel.

By entering the Venue, you grant the Organizer and its sponsors, partners, and licensees an irrevocable, royalty-free, perpetual, worldwide license to record, photograph, broadcast, livestream, and otherwise capture your image, likeness, voice, and statements, and to use, edit, reproduce, and distribute the resulting material in any medium now known or later developed, for any purpose including promotional, editorial, and commercial use, without further notice, consent, or compensation.

If you do not wish to appear in Festival media, please notify staff before entry; we will make reasonable efforts to honor opt-outs but cannot guarantee removal from incidental crowd footage.

Attendee-shot content

Personal phone photos and videos for non-commercial, personal use are welcome and encouraged. Live-streaming entire sets, redistributing audio or video for commercial purposes, or selling photos/videos taken at the Festival is prohibited without prior written authorization from Hello@Partake.NYC.

Weather & Force Majeure

Rain or shine. Mostly.

Freedom Cup Fest is a rain-or-shine event. Programming will continue through ordinary weather, with covered zones available. The Organizer may, at its sole discretion, delay, shorten, evacuate, or modify the program for severe weather, lightning, extreme heat, public-health directives, or other safety reasons. Any such modification is not grounds for a refund (see §03).

The Organizer shall not be liable for any failure or delay in performance caused by events outside its reasonable control, including but not limited to: acts of God; severe weather; fire, flood, or earthquake; pandemic, epidemic, or public-health order; act of war, terrorism, or civil disturbance; strike or labor dispute; loss of utilities or transit; performer no-show; venue closure; or government action.

Vendor & Sponsor Terms

Brand-side participation.

Vendors, sponsors, and brand partners participate under a separate written agreement executed with the Organizer. The summary below is informational and does not replace those agreements.

Applications & approval

Submitting a vendor application or sponsor inquiry through this site does not create a contract. All participation is subject to written approval, deposit, and execution of the applicable vendor or sponsorship agreement. The Organizer reserves the right to reject any application at its sole discretion.

Insurance & permits

Food and beverage vendors must hold current NYC Department of Health permits and provide a Certificate of Insurance naming Elevated LIC LLC and Partake LLC as additional insured, with minimum coverage as specified in the vendor agreement (typically $1M per occurrence / $2M aggregate CGL, plus liquor liability where applicable). Vendors and sponsors are responsible for collecting and remitting all applicable sales tax and for the conduct, insurance, and indemnity of their own employees and contractors. See also §08 — Release & Indemnification.

Branding & activations

All on-site signage, activations, sampling, giveaways, and brand content require prior written approval. Sponsors and vendors may not co-brand with, distribute materials for, or sub-license rights to any third party without the Organizer's written consent.

Brand kit submissions

Materials uploaded via the brand kit portal are submitted under a license permitting the Organizer to use, reproduce, and adapt them for Festival promotion. Vendors and sponsors represent that they own or have the right to license everything they upload.

Privacy Notice

What we collect and why.

When you fill out a contact, ticket, vendor, sponsor, or brand-kit form on this site, we collect the information you provide (such as name, email, phone, company, and the contents of your message) and standard server logs (IP, user agent, timestamps). We use this information to:

  • Respond to your inquiry and fulfill your ticket, vendor, or sponsor relationship
  • Send you transactional confirmations and event updates
  • Send you marketing emails about future Freedom Cup Fest events (opt-out in every email)
  • Improve the site and detect fraud or abuse

Sharing

We do not sell personal information. We share it only with: ticketing and payment processors who need it to complete your transaction; the Venue, for entry and safety; and law enforcement when required by a valid legal request.

Retention

We retain inquiry and application data for up to 36 months after our last interaction with you, and transactional records for the period required by applicable tax and accounting law.

Your rights

You may request access to, correction of, or deletion of your personal information at any time by emailing Hello@Partake.NYC. Residents of California, Colorado, Connecticut, Virginia, and other states with consumer privacy laws have additional rights under those statutes, which we will honor.

Cookies

This site uses essential cookies for navigation and form handling. We do not currently run third-party advertising trackers. If that changes, we will update this notice and, where required, request your consent.

Intellectual Property

Marks, logos, and content.

FREEDOM CUP FEST, the cup-and-flag mark, and the visual identity of this event are trademarks and trade dress of the Organizer. The names, logos, and marks of Partake, Elevated at Partake, performers, sponsors, and vendors are the property of their respective owners and used here with permission.

No part of this site, the Festival's promotional materials, or on-site signage may be reproduced for commercial purposes without prior written consent. Personal social-media sharing with credit is welcome.

If you believe content on this site infringes your copyright, send a DMCA-compliant notice to Hello@Partake.NYC with: identification of the work, identification of the allegedly infringing material with URL, your contact information, a statement of good-faith belief, a statement under penalty of perjury that you are authorized to act, and your signature.

Accessibility

We want everyone in the room.

The Festival is committed to providing reasonable accommodations to attendees with disabilities, in line with the ADA and applicable state and local law. Accessible entry, viewing platforms for the 40-foot LED screen, accessible restrooms, and quiet zones are available on-site.

Service animals as defined by the ADA are welcome. Emotional support animals and pets are not permitted.

If you need an accommodation — sign-language interpretation, ASL meet-and-greet access, a wheelchair-accessible table, dietary information for vendor food, or anything else — email Hello@Partake.NYC with subject line ACCESS at least 14 days before the event. We will do everything reasonable to make it work.

Disclaimers & Limitation of Liability

Read this part carefully.

The Festival and this website are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The Organizer does not warrant that the site will be uninterrupted, error-free, or secure, or that lineups, schedules, and other published information will be accurate or final.

To the maximum extent permitted by law, the aggregate liability of the Released Parties (collectively) to you, arising out of or related to the Festival, your attendance, this site, or these terms, shall not exceed the lesser of (a) the amount you actually paid for your ticket(s) for the affected day, or (b) one hundred U.S. dollars ($100). The Released Parties shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, loss of enjoyment, or loss of goodwill, even if advised of the possibility. This limitation applies regardless of the legal theory (contract, tort, statute, or otherwise) and survives termination of these terms.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so portions of this section may not apply to you. Nothing here limits liability that cannot lawfully be limited.

Disputes & Governing Law

If something goes sideways.

Please contact us first at Hello@Partake.NYC. We aim to resolve most matters informally within thirty (30) days.

These terms are governed by the laws of the State of New York, without regard to its conflict-of-laws principles. Any dispute that is not resolved informally shall be brought exclusively in the state or federal courts located in Queens County, New York, and you consent to the jurisdiction of those courts. You waive any right to a jury trial and agree that any action must be brought in your individual capacity, not as a plaintiff or class member in any class, collective, or representative action.

Honest Reviews, False Statements & Confidential Information

Tell the truth. That's the rule.

★ Your right to review is protected

Nothing in these terms restricts your right under the federal Consumer Review Fairness Act and applicable state law to post or share honest reviews, ratings, opinions, photos, videos, or other truthful commentary about your experience at the Festival, in any forum and in any medium. We welcome real feedback — it makes the event better.

What is prohibited (attendees)

You agree that you will not, in connection with the Festival or the Released Parties, make or publish any statement that you know (or reasonably should know) to be:

  • False or materially misleading as to a matter of fact (as distinct from opinion)
  • Defamatory, libelous, or slanderous
  • Designed to fraudulently impersonate an attendee, employee, performer, or official of the Festival
  • An unauthorized disclosure of confidential, non-public business information shared with you in a credentialed or back-of-house capacity
  • A use of the Festival's trademarks or trade dress in a manner that falsely implies endorsement, partnership, or affiliation

This section is intended to address falsity and fraud, not opinion. Negative reviews, criticism, satire, parody, and protected speech are not covered.

Carve-outs that always apply

Nothing in these terms shall be construed to limit your right to:

  • Post truthful reviews and ratings on any platform
  • Communicate with, file a complaint with, or testify before any regulator, court, or law-enforcement agency
  • Exercise rights under labor, whistleblower, or civil-rights laws
  • Respond truthfully to a lawful subpoena or other legal process
  • Engage in any other speech protected by the First Amendment or applicable law

Vendors, sponsors, performers, contractors, staff

Parties acting under a separate written agreement with the Organizer — including vendors, sponsors, performers, talent agencies, production contractors, security, and staff — are also bound by the confidentiality, non-disparagement, and publicity terms set forth in their respective agreements, which may be broader than this section to the extent consistent with applicable law. In the event of a conflict between this section and any such written agreement, the written agreement controls as to that party.

Remedies

The Organizer reserves the right to pursue any lawful remedy for breach of this section, including the takedown of false statements, recovery of damages, and injunctive relief. The Organizer will not assert this section against honest reviewers, journalists reporting in the public interest, or any person engaged in protected speech.

Changes to These Terms

This page can change.

The Organizer may update these terms at any time. The effective date in the header above will reflect the most recent revision. Material changes will be noted on the Festival homepage where reasonably practicable. Your continued use of the site or attendance at the Festival after a revision constitutes acceptance of the updated terms.
